How to File a DMCA Takedown Notice

If you believe that material on our Website infringes your copyright, send a notice that includes the following elements required by 17 U.S.C. §512(c)(3):

  • A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (exact URL(s) on our site are essential).
  • Your contact information: full name, organization (if applicable), postal address, telephone number, and email address.
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Notices missing required elements may be delayed or returned for completion.

How to File a DMCA Counter-Notice

If your content was removed or disabled due to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice pursuant to 17 U.S.C. §512(g). Your counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location (URL) where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, postal address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (if in the United States), or, if your address is outside the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who submitted the original DMCA notice or their agent.

Upon receipt of a valid counter-notice, we may restore the material within 10–14 business days unless the original complainant informs us that they have filed a court action seeking to restrain the allegedly infringing activity.

Repeat Infringer Policy

247DurbanVacancy may, in appropriate circumstances and at our discretion, disable or terminate access for users who are deemed repeat infringers. We track DMCA determinations and related removals and may apply progressive enforcement, including restriction or termination, consistent with applicable law and our Terms of Service.

Misrepresentation and Abuse

Submitting false claims or materially misrepresenting infringement may expose you to liability under 17 U.S.C. §512(f) and other laws. Use the DMCA process responsibly. If you are unsure whether the material is infringing, consult legal counsel before filing a notice.

Content Located on Third-Party Sites

Many job listings and related materials linked on our Website are hosted by third parties. If the allegedly infringing content is not on our servers or under our control, we may be unable to remove it. Please direct your notice to the appropriate hosting provider or website owner.

Reservation of Rights

We reserve the right to remove content, restrict access, or take other actions as necessary to comply with the law, protect rights holders, and maintain the integrity of our services. We also reserve the right to decline to act on notices that we reasonably believe are defective, abusive, or invalid.

Privacy and Data Handling

DMCA notices and counter-notices include personal data. By submitting, you consent to our use and disclosure of this information as necessary to process the claim, including sharing with the affected party, service providers, hosting companies, courts, and, in our discretion, public archives. For more information, see our Privacy Policy.
